Statutory Right of Withdrawal (for consumers within EU and EEA member states)
You have the right to withdraw from this contract, without reason, within fourteen days.
The withdrawal period lasts fourteen days from the day on which you, or a third party designated by you, who is not the carrier:
- take(s) the goods (including any outstanding Certificates of Authenticity) into possession, or…
- in the case that multiple products from a single order arrive separately, take(s) the final goods (including any outstanding Certificates of Authenticity) into possession.
To exercise your right of withdrawal, you must inform us (Scott Holt Fine Art, Mittelstrasse 13, 24568 Oersdorf, Germany; Tel.: +49 4191 2744167; e-mail: scott@scottholtart.com) of your decision to withdraw from this contract in a clear, written statement (for example, by postal letter or e-mail). You may use, but are not obliged to use, the Model Withdrawal Form below, or the downloadable .pdf Model Withdrawal Form available here.
The deadline for the right of withdrawal is met if the statement indicating that you are exercising your right of withdrawal is sent before the end of the allotted withdrawal period.
The Consequences of Withdrawal
Should you withdraw from this contract, we are to refund all payments received from you, including shipping costs (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) promptly – at the latest, within fourteen days of our receipt of the statement indicating your withdrawal. Refunds will be credited back to the original payment method that you used for this transaction, unless otherwise expressly agreed upon. Under no circumstances will you be charged any fees for this refund.
We may withhold the refund until such time as we have received the returned goods (including any Certificates of Authenticity) or until you have provided proof of their return shipment, whichever comes first.
You are to send or transfer the goods, in the original packaging, to us without delay, and at the latest within fourteen days from the day on which you informed us of your withdrawal from this contract. This deadline is met if the return shipment is sent before the end of the allotted fourteen day period.
You shall bear the direct cost of return shipping for your order. In some cases of oversized shipments, goods cannot be returned by normal post and a specialty forwarding firm may be required. The maximum costs are estimated to be Euros 350.00.
You are only responsible for possible decreases in the value of goods if, after inspecting their condition, properties, and functionality, the decrease in value can be traced back to your improper handling of the goods.
Qualifier to the Right of Withdrawal
In accordance with section §312g Para. 4 (1) of the German civil code (BGB), the right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and the production of which is governed by an individual choice of, or decision by the consumer, or that are clearly tailored to the customer’s personal needs.
